Terms of Service
Drafted from PLAN.md section 12. Not legal advice; a lawyer must review before payments are taken.
DRAFT for legal review. This is a working draft written from the product plan. It is not legal advice, it has not been reviewed by a lawyer, and it must not be published as final until it has been. Text in square brackets is for the owner to fill in.
These terms are between you and The Casey Company LLC, doing business as SocialScrape ("SocialScrape", "we", "us"), a Texas limited liability company. By creating an account, creating an API key or using the service you agree to them. If you use the service for an organisation, you confirm you can bind it to these terms.
1. The service#
SocialScrape is a developer API and website that returns publicly available social media data in a consistent format, and related tools such as transcription, monitors and webhooks (the "service"). The documentation at socialscrape.io/docs describes how it works. We may change, add or remove features; for a breaking change to an endpoint we give notice in the changelog and keep the old version running for a reasonable period.
2. Public data only#
The service only retrieves content that a visitor who is not logged in can see. We do not log in to any platform, do not use accounts of any kind to collect data, and do not serve private content. We do not offer face analysis or inference of sensitive traits such as age or gender from images. You must not ask the service, or help anyone else ask it, to do any of these things.
We do not own or control the data. It belongs to the people and platforms that published it. We make no claim over it, and you are responsible for how you use it (see section 6).
3. Accounts, teams and keys#
- You must give accurate information and be old enough to form a binding contract where you live.
- Credits, keys and billing belong to a team. The team owner is responsible for what the team's members and keys do.
- Keep your keys secret. You are responsible for requests made with your keys until you revoke them. Tell us at [email protected] if a key is compromised.
- Each person may claim the free credits once. We may refuse or reverse a grant that was obtained by creating multiple accounts, using disposable addresses or other abuse.
- We may rate limit, suspend or revoke a key or team that breaks these terms, the acceptable use policy or the law, or that puts the service at risk. Where we reasonably can, we tell you why.
4. Credits, payment and refunds#
- A request costs the number of credits stated in the documentation. Failed requests and cached repeats cost nothing.
- Packs are one-time purchases. Pack credits do not expire, have no cash value and cannot be transferred out of the team or exchanged for money, except as stated below.
- Monthly plans renew automatically until cancelled. Plan credits reset each month and do not roll over. Annual billing is charged up front.
- You can get a full refund of a pack within 14 days of purchase if none of its credits have been used. We do not refund otherwise, and we do not refund plan fees for a month already started, except where the law requires.
- If a plan payment fails, plan credits stay usable for 7 days and then expire until payment succeeds.
- When a team is closed, its unused credits are forfeited.
- Payments are processed by Stripe. Prices are in US dollars and exclude taxes, which we collect where required. We may change prices for future purchases; a change never reduces credits you already hold.
- [Owner to confirm: how chargebacks are handled and whether credits are removed when a payment is disputed.]
5. What we promise and what we do not#
We aim for a reliable service and publish a status page. But platforms change without notice, block access, or remove content, so we cannot guarantee that any endpoint will keep working, return every item, or return data that is complete, current or accurate. The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
6. Your responsibilities#
You are responsible for your use of the data, including compliance with the law (privacy and data protection, consumer protection, anti-discrimination, copyright, anti-spam), with the terms of any platform you act on, and with the acceptable use policy. In particular:
- Posts, comments, transcripts and media can be protected by copyright and by privacy law. We are a retrieval tool; we do not grant you any right in the content.
- If you store or process personal data you received through the service, you are the controller of that data and must have a lawful basis for it.
- Do not resell raw personal data, and do not use the service to build a database of private individuals.
7. Intellectual property#
We own the service, its code, documentation and design. You get a limited, revocable, non-exclusive right to use the service under these terms. You may use the output you receive for your own products, subject to section 6. Feedback you give us may be used without obligation.
8. Privacy and takedown#
How we handle personal data is described in the privacy policy. Anyone can ask us to remove data about them or to stop serving it through takedown and opt-out. We honour copyright notices as described there.
9. Suspension and termination#
You can stop at any time by deleting your team. We can suspend or end your access immediately if you break these terms, if we must by law, or if your use harms the service or others. Sections that by their nature should survive (payment, disclaimers, liability, indemnity, governing law) do.
10. Limit of liability#
To the fullest extent the law allows: (a) we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and (b) our total liability for all claims relating to the service is limited to the fees you paid us in the 12 months before the event that gave rise to the claim. Nothing in these terms limits liability that cannot be limited by law.
11. Indemnity#
You will defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your use of the service or the data in breach of these terms or the law, including claims by platforms or individuals about how you used what you retrieved.
12. Governing law and disputes#
These terms are governed by the laws of the State of Texas, USA, without regard to conflict of laws rules. The courts located in [county to be confirmed by the owner], Texas have exclusive jurisdiction, except that either party may seek urgent relief anywhere. [Owner and lawyer to decide whether to add arbitration and a class action waiver.]
13. Changes and contact#
We may update these terms. If a change is material we will tell account owners by email or in the dashboard before it takes effect, and the date of the version you accepted is recorded. Using the service after the effective date means you accept the new terms.
Questions: [email protected]. Legal notices: [postal address to be added by the owner].
